Divorce is the process of dissolution of a marriage. In India, the process of divorce is initiated by filing of a petition under the applicable Act (Hindu Marriage Act, 1955, Indian Divorce Act, 1869, Special Marriage Act, 1956, The Dissolution of Muslim Marriages Act, 1939, etc., as the case maybe) before a court of jurisdiction, and culminates in the pronouncement of final order of the divorce. Divorce procedure in India can be either divorce by mutual consent or contested divorce.
Divorce proceedings, like any legal proceedings constitute of various stages viz., service of summons, trial, interim relief, arguments, final order.
