1. What is INC 3?
INC - 3 is an e form that is used to file the consent of the nominee in the case of One person company. Since OPC has only one person as to its member, therefore, it is mandatory for the OPC to file form INC 3 giving the details as well as the consent of the person who shall act as the member of the company in the event of death of the subscriber. The nominee of a one-person company must mandatorily be an Indian citizen and Indian resident over the age of 18 years. To be nominated as a nominee, the nominee must submit a copy of PAN card along with an address proof and residence proof that is less than 2 months
2. Why is it important?
This form provides consent of the person who shall act as a member of the OPC in the event of the death of the subscriber. Through this form, the nominee shall declare that he will act as a member of the OPC and is eligible to be appointed as a member of OPC as per the Companies Act 2013.
